1. Acceptance of these terms
The Athletic Way (“we,” “us,” or “our”) operates theathleticway.com (the “Site”). By using the Site, you agree to these Terms of Service. If you do not agree, please discontinue use. Our Privacy Policy explains how we collect, use, and share information when you visit the Site or contact us.

2. Use of the Site
You may use the Site to learn about our training programs, read fitness articles, and contact our team. When you submit a form, provide accurate information and use contact details you are authorized to share.

You may not use the Site to impersonate someone, send spam or threatening messages, collect other visitors’ personal information without permission, or infringe another person’s rights. You may not introduce malicious code, bypass security measures, or interfere with anyone’s ability to use the Site.

3. Introductory sessions and training services
When you request a free introductory session through the Site, our team will contact you to discuss your goals and availability. Your appointment is confirmed once we agree on a date and time. Submitting the form does not enroll you in a paid training program. If you join our one-on-one or small group personal training program, the agreement you accept at enrollment governs your training, fees, and cancellation terms.

4. Email and text messages
Email. When you contact us, we may email you to answer your question or coordinate a visit. You can unsubscribe from promotional emails using the unsubscribe link in the email or by contacting us.

Service texts. If you select the service-text option on our form, The Athletic Way may text you about appointments, schedule changes, account information, and customer service requests.

Marketing texts. If you separately select the marketing-text option, The Athletic Way may text you about offers, services, and events. You can choose service texts without choosing marketing texts. Consent to marketing texts is optional and is not a condition of purchase.

Your choices. Message frequency varies. Your carrier’s message and data rates may apply. Reply STOP to opt out of texts or HELP for assistance. You can also contact us using the details below.

5. Fitness information
Our articles, exercise descriptions, and member stories provide general fitness information. They do not provide medical advice or assess whether an exercise is appropriate for you. If you have an injury, a medical condition, or questions about exercising safely, consult a qualified healthcare professional before following exercise guidance from the Site. Members’ results reflect their own experiences. We cannot promise a particular outcome.

6. Intellectual property
The Athletic Way or its licensors own the Site’s articles, photographs, videos, logos, and other original materials. You may read, print, or save materials for personal use and share links to our pages. Except as permitted by law, you need written permission from the rights holder to republish, sell, modify, or distribute those materials.

7. Third-party websites and online store
The Site links to services hosted by others, including our online merchandise store. When you follow a link to another site, its terms and privacy policy apply to your use of that site. For merchandise orders, review the payment, shipping, and return terms shown by the store before placing your order.

8. Site availability and limitation of liability
We provide the Site as available. We cannot guarantee that every page will always be accurate, accessible, or free of errors. To the extent permitted by law, The Athletic Way is not liable for indirect or consequential losses, such as lost profits or data, arising from your use of the Site or an interruption in access. This section applies only to website use and preserves all rights and remedies that cannot be limited by law.

9. Indemnification
To the extent permitted by law, you agree to reimburse The Athletic Way for reasonable costs and damages arising from a third party’s claim to the extent that your unlawful use of the Site or your infringement of that party’s rights caused the claim.

10. Governing law and updates
New Hampshire law governs these Terms, subject to any mandatory protections that apply where you live. If a court finds a provision unenforceable, the remaining provisions continue to apply.

We may revise these Terms as the Site or our services change. We will post the revised version here with an updated date and provide additional notice or request consent when required by law. The revised Terms apply to your use of the Site from their effective date forward.

Kyle and his team are great at what they do. As an ex-college athlete and avid weight lifter, I was riddled with several injuries from college sports and lifting. Kyle has elevated my workouts significantly.
